These terms and conditions (the "Terms and Conditions") govern the use of www.nancymichielicoaching.com (the "Site"). This Site is owned and operated by Nancy Michieli Consulting. This Site is a coaching and hypnosis site.

By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to abide by them.

Intellectual Property.

All content published and made available on our Site is the property of Nancy Michieli and the Site's creators. This includes but is not limited to images, text, logs, documents, downloadable files and anything that contributes to the composition of our Site.

Nancy Michieli is a certified independent provider of the Process Communication ModelⓇ and all materials related thereto, which are the proprietary rights of Kahler Communications, Inc. The Kahler Communication name is used by express permission, and this person, entity, or firm is otherwise not associated with, nor owned, in whole or part, or controlled or managed by Kahler Communication, Inc.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;

  • Violate the rights of other users of our Sitel

  • Violate the intellectual property rights of the Site Owner or any third party to the Site;

  • Hack into the account of another user of the Site;

  • Act in any way that could be considered fraudulent; or

  • Post any material that may be deemed inappropriate or offensive.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we resolve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Age Restriction

You must be at least eighteen (18) years of age to use this Website or any services. By using this Website, You represent and warrant that You are at least 18 years of age and may legally agree to this Agreement. The Company assumes no responsibility or liability for any misrepresentation of Your age.

Client Agreements

As a client,

  • I understand and agree that I am fully responsible for my physical, mental and emotional well-being during my sessions, including my choices and decisions.  I am aware that I can choose to discontinue at any time.1.     As a client, I understand and agree that I am fully responsible for my physical, mental and emotional well-being during my sessions, including my choices and decisions.  I am aware that I can choose to discontinue at any time.

  • I understand that “hypnosis/coaching” is a Professional Client relationship I have with my hypnotist/coach that is designed to facilitate the creating/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

  • I understand that hypnosis/coaching does not involve the diagnosis or treatment of mental disorders as defined by the Canadian Psychiatric Association.  I understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment or therapy.

  • I promise that if I am currently in therapy or otherwise under the care of a mental health professional, that I have consulted with the mental health care provider regarding the advisability of working with a coach/hypnotist and that this person is aware of my decision to proceed with this relationship.

  • I understand that information will be held as confidential until I state otherwise, in writing, expect as required by the law.

  • I understand that certain topics may be anonymously and hypothetically shared with others for the purpose of education.

  • I understand that coaching/hypnosis is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other matters.  I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my sole responsibility.

  • I agree to attend my sessions on time.   If I am unable to attend I will provide 24 hours notice to change the timing of my session.  If a session is cancelled within 24 hours I agree to pay the full amount.

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspect or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods and Services

These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are available on our Site:

  • Leadership and Communication Self Paced Training Programs

  • Hypnosis and Meditation Recordings

The following services are available on our Site:

  • Rapid Transformational Therapy (Hypnosis)

  • Leadership and Communication Coaching and Training

  • Holistic Life, Career and Executive Coaching

The services will be paid for in full or as per the payment schedule when the services are at the time of order

These Terms and Conditions apply to all the goods and services displayed on our Site when you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. Therefore, you agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid for the services remaining not rendered. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Subscriptions

Your subscription automatically renews, and you will be automatically billed until we receive notification that you want to cancel the subscription.

To cancel your subscription, please follow these steps:

  • Submit a request to support@nancymichielicoaching.com requesting to cancel

  • Submissions can be submitted up to 24 hours before the renewal, or the cancellation will occur the following month.

  • Access to subscription will be available until the renewal date; once a cancellation has been requested.

Payments

We accept the following payment method on our Site.

  • Credit Card; and

  • PayPal

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. In addition, by providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Refunds:

Refunds for Goods

100% Refund requests must be made within 15 days of purchasing your goods.

Refunds apply to the following goods:

  • Leadership and Communication Self-Paced Training Programs

  • Hypnosis and Meditation Recordings

Refunds will cancel access to these programs.

Refunds for Services

We provide refunds for services sold on our Site as follows:

  1. Thirty days before the first Live Training, Coaching, or RTT Session client is eligible to receive a 90% refund.

  2. Fifteen days before the first Live Training, Coaching, or RTT Session client is eligible to receive a 50% refund.

  3. Refunds will not be provided within 15 days of the first live training/session.

  4. Within 15 days of the first session, a client can request to reschedule or transfer to another session if availability allows.

No Guarantees:

WE MAKE NO GUARANTEES AS TO OUR PROGRAMS, PRODUCTS, SERVICES, OR PROGRAM MATERIALS. YOU AGREE THAT PROGRAMS, PRODUCTS, SERVICES, OR PROGRAM MATERIALS ARE PROVIDED "AS IS" AND WITHOUT GUARANTEES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED GUARANTEES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PROGRAMS, PRODUCTS, SERVICES, OR PROGRAM MATERIALS WILL BE FUNCTIONAL, UNINTERRUPTED, CORRECT, COMPLETE, APPROPRIATE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THE WEBSITE, CONTENT ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF OUR PROGRAM, PRODUCT OR SERVICES MATERIALS OR ON THIRD-PARTY WEBSITES IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE.

Errors and Omissions. We make no guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information in our Programs, Products, Services, and Program Materials. Every effort has been made to present you with the most accurate, up-to-date information, but because the nature of scientific research is constantly evolving, we cannot be held responsible or accountable for the accuracy of our content. You acknowledge that such information may contain inaccuracies or errors and we are not liable for any such inaccuracies or errors to the fullest extent permitted by law.

Consumer Protection Law

Where the Consumer Protection Act or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

Nancy Michieli and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses, including legal fees from your use of this Site.

Indemnity

Except where prohibited by law, by using this Site, you indemnify and hold harmless Nancy Michieli and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses, including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal, and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time to maintain compliance with the law and reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of these changes to the Terms and Conditions or post a notice on our Site.
